On August , the "Trail of Tears" had begun for the Cherokee Indians. The Government (white men) was forcing the Indians of its tribal land to the west to unfavorable land. The Cherokee embarked on the long bitter journey to Oklahoma from Georgia. Make shift stockades were constructed by General Winfield Scott before the actually journey began. The army started to gather Indians on May to put them in the newly constructed stockades (prisons). They Indians were treated unfairly no warning was given to them, instead they were captured doing their every day chores such as farming and tending to house hold duties. The white people where eager to come and claim land and look for gold as soon as the Indians were carried away. Once Andrew Jackson became president he pushed his views on the public. Jackson thought that Native Americans should be forced to move for the expanding settlements.

Jackson main interest was to acquire the land the Cherokee had, so he and other potential landowners could profit from the land. Jackson was all about the almighty dollar. Although the Cherokee had been his allies in the earlier war against the Creeks, Jackson had made no secret of the fact that he strongly favored the removal of all Native Americans to lands west of the Mississippi River.(Page 1 Discovering the American Past) Jackson used the Indians when he needed them and betrayed them when the opportunity would arise. Jackson feels that it would be out of the government interest and a waste of time to try to civilize the Indians, because once they are civilized and have permanent settlements it would be harder to move them or purchase their land at a cheap price. He also feels that the Indians have been kept in a state of uncertainty and will soon start to realize that the Americans are unfair and do not care about their fate just their land and the money that could be made from it. President Thomas Jefferson tries to convince the Indians on why it would be best for them to move westward. Jefferson tries to use a different approach by telling the Indians that the cause of their troubles are very plain and the remedy can only be fixed by the Indians their selves. Jefferson tells the native people that they have drove the buffalo and deer westward and that it would be better for them to move westward to follow them. Jefferson also tells the Indians that every year they have been a part of no food do to the fact of not knowing how to cultivating. He also tries to show them that the whites have double their population every twenty years while the Indians numbers continue to decline do wars and abuse of liquor. Jefferson says this is because whites raise livestock and know how to cultivate the earth. He tries to convince the Indians to double their numbers, by giving up their own ways and confirm to the ways of the white man. If they do this they will become great people. They will become great people if and only if the women learn how spin and weave clothes, while the men must put down their weapons and pick up ploughs and hoes to farm. Jefferson encourages the Indians to marry white people so the blood can mix and the Indians can become one. This is a way to eliminate the Indians through social and economic ways. He wants to change the whole life style of the Indians instead of learning how to live with one another

President Jackson and Jefferson have the same overall goal, which are to eliminate the Indians. The only difference is that Jackson uses the technique by any means necessary and Jefferson has a different approach that will take patients and time.

The topic that I wanted to learn more about in this section is punitive damages. I have seen in the news recently about cases where the plaintiff has been awarded millions of dollars. I wanted to know how the plaintiff would be eligible for the right of punitive damages and some of the history behind the ruling. I also wanted to learn about the some of the largest settlements in history as well.

Six percent of winning plaintiffs in civil jury trials walk away with punitive damage awards, according to recent U.S. Department of Justice statistics. Some multi-million dollar punitive damage verdicts soar to over 500 times the amount of jury-awarded compensatory damages. Punitive damages are subject to award in nearly all states. In most states, punitive damages are also insurable. Across the country it appears that punitive damages have increased dramatically in frequency and amount when submitted to the jury for consideration. In part, this trend may be attributable to the fact that the public generally has been desensitized to multi-million dollar verdicts.

A case that I thought was very interesting was in 16, the Supreme Court decided BMW v. Gore. The Supreme Court there determined that the amount of a punitive award could be so grossly excessive that it would violate the Due Process Clause of the Fourteenth Amendment. In its decision, the Court examined three "guideposts" for determining whether an award was "grossly excessive." Subsequent judicial decisions have distinguished Gore on its facts instead of following Gore's overriding principal. BMW v. Gore involved the purchase of a "new" BMW by Dr. Gore. The facts disclosed that, prior to purchase, the vehicle had been damaged by acid rain. BMW repainted the car but sold it as "new," without disclosing the fact that it had been repainted. Evidence at trial indicated that the resale value of the car was reduced by approximately $4,000. However, the jury awarded Dr. Gore $ 4 million in punitive damages, which the Alabama Supreme Court later reduced to $ million.

After some research the largest punitive damage settlement I found, if you can't already guess, is against the tobacco industry. I learned that smokers in a 000 landmark case asked for up to $16 billion in punitive damages from the tobacco industry Monday to punish it for ruining the lives of millions of sick and addicted customers. The class-action case was based on behalf of 00,000 to 700,000 sick Florida smokers against the nations five biggest cigarette makers. The tobacco companies have argued they should not be required to pay any more than their combined net worth of $15. billion, the difference between assets and liabilities on financial balance sheets. As defendants, the five companies have argued they dont deserve to pay punitive damages because theyve changed their ways. The executives have pointed out a stepped up anti-youth smoking campaign, a Web site outlining tobaccos risks, and withdrawing advertisements in popular magazines including People and Sports Illustrated. Their attorneys have insisted the approximately $54 billion nationwide the settlement currently being paid over 5 years is punishment enough.

As you can tell by the way court case are portrayed in the media, the ones that get most of the attention are the usually have huge punitive damages settlements associated with them. Punitive damages in a way, are the symbol of law in America. In most of the cases there are two positive outcomes. The plaintiffs that are rewarded the huge settlements and the corporations paying them, hopefully learning a lesson.

Anglo-Saxon Culture And The Poem "Beowulf"

The aspects of Anglo-Saxon culture are reflected in the poem Beowulf. In 44, the first band of people from the great North German plain crossed the country of Kent. They were the Jutes. Following the Jutes came

Angles and Saxons. These Germanic tribes brought with them a common language and created the Anglo-Saxon England that lasted until 1066. The elements of the Anglo-Saxon culture, such as a fierce life of a warrior or seaman, a heroic ideal, the boisterous and ritualized customs of the mead house, and the importance of both Pagan Germanic and Christian beliefs are all portrayed in the poem Beowulf.

The fierce hardy life of the Anglo-Saxon warrior or seaman were depicted in Beowulf. In the poem, warfare is as ordinary as common life. Beowulf himself serves as the fierce warrior. The way of the warrior is to gain respect from fellow countrymen and kings. Without battle, a warriors life could never be fulfilled. People of Anglo-Saxon civilization admired men of outstanding courage.

Besides a common language, Anglo-Saxons shared a heroic ideal and a set of traditional heroes. In the epic poem Beowulf, Beowulf is the epic hero. He embodies the ideals and virtues valued by the Anglo-Saxon culture. Beowulf is a confident warrior. He is sure of himself and boasts frequently. An example would be in lines 5-54 when Beowulf claims, no man swims in the sea as I can, no strengith is a match for mine. In addition to being confident, Beowulf is also brave and loyal. He shows his loyalty in lines 1-14 where it is written, Edgethos brave son, then assured the Danish queen that his heart was firm and his hands Ready.

Help with essay on Anglo-Saxon Culture And The Poem "Beowulf"

Also, the boisterous customs of the mead house played a major role in Anglo-Saxon culture. The mead house was built to celebrate victories. In Beowulf, the mead hall was called Herot. Mead was a popular liquor that people drank during the banquets. In the poem, a monster named Grendel murdered thirty men. From that point on, Herot was left with a taint of evil.

Beowulf shows that the Anglo-Saxons had strong Pagan Germanic and Christian ideals. The Biblical reference in the epic serves to give an idea of the extent of Grendel's pure evil and gives a logical explanation for Grendel's murderous behavior. Grendel would kill the Danes for no reason other than their happiness. One example of religious reference in Beouwulf would be when Hrothgar states, "Our Holy Father had sent Beowulf as a sign of His grace, a mark of His favor, to help us defeat Grendel and end that terror." This religious description shows Beowulf as a sort of messiah sent by God to save man from evil. Beowulf is in fact not a messiah so this description shows the good in Beowulf's heart and the purpose of his mission. He is a hero. The Anglo-Saxons believed in the power of God and that He had sent Beowulf to them.

Beowulf is an example of Anglo-Saxon culture and tradition. The epic poem portrays the lifestyles of people during the Anglo-Saxon period. An example would be how the lives of the warriors were greatly respected by people in villages and tribes. Also, God was a huge factor in an AngloSaxons life. It was believed He held great power and the ability to determine ones fate. In conclusion, Beowulf is a fictional poem that holds many true facts concerning the lives and culture of the Anglo-Saxons.

Ginger and I sat on the bus, positioning ourselves in any way we could to avoid being uncomfortable during the five hour bus ride to the Dells. We ate a bag of Cheese-Its, always the snack of choice for our yearly adventure up north. I used to count the salt crystals on one of the Cheese-Its before I would allow myself to gorge on them. She would lick her fingers, one of the few unlady like mannerisms she possessed. I would stare and admire her, the only woman I had ever shared my life with, as she licked the salt and it dissolved on her lips.

Ginger was not the average teenager; she had been raised by a "normal" family by American standards. She also attended Bible Baptist School for the first nine years of her schooling. Her naïve mind held her at a disadvantage. She was rushed into the public school system, and suffered I guess what you would call culture shock for the first semester. I was the first person she encountered and befriended. I got to know her feelings about "me" but I put them aside, she was my Ginger. My Ginger never lied to me, was always honest. She knew what to say, what not to say, and how to say it. We spent a lot of time talking about how everyone said we should get together and how we argued like husband and wife. We did everything together: joked, laughed, and played. Not a day went by without our joking of how we were going to get married and have tons of kids and live in the perfect house. "Married" and "Perfect", words that are now so far from me. I cherished her every word and utterance. We were closer friends than either of us had been with anyone of the opposite sex, and I never thought of anything more. I was content, I had my Ginger. But I was about to realize how selfish I was. In me not allowing her to know the real "me", I was hurting not only myself, but she was beginning to fall in love. At least as much of love as a sixteen year old girl can fall in.

The part I hated most about our yearly trip was the room assignments at the hotel, six guys to a room and only three beds. I prayed that I would get stuck in a room with the five ugliest guys on the trip. I could use Ginger as a cover up in public, but there would be no excuses if one of my roomies caught me staring at their ass as they came out of the shower. I somehow managed to control myself for the last couple of years, but this my last year, I failed to be successful in my attempts. The worst part came around two in the morning when we were settling down for bed. In past years three guys would sleep in each of the three beds and the others who were not so lucky found themselves a spot on the floor. Their insecurity for me was a God send, but God wasn't so giving this year. I of course got stuck with a fairly good looking bunch. One of them was pretty cute. I watched his mouth move as he talked on the phone while I lay in bed, I didn't pay much attention as to what he was saying, and I was just taking him in. Then he hung up the phone, while I pretended to be asleep. He hesitated, scanned the room, and then decided that the bed I was in appealed to him most. He climbed in and got comfortable. Meanwhile I lay there so nervous I was about ready to mess myself. I knew nothing was going to be made of this situation; it was just that it was the closest I had ever got to actually attaining one of the objects of my affection. Despite my nervousness, I had my ways of showing I was attracted to him. As he was getting into a comfortable position, he just happened to knock me in my "way of showing I am attracted to you" area. We both opened our eyes, he was half asleep, but I was wide awake. I was too scared to

In a market economy, the majority of a nation's land, factories, and other economic resources are privately owned by businesses or individuals. Even though the government has little or no direct involvement, it still has an influence in improving the market's economy by creating antitrust laws, providing a stable fiscal and monetary environment, and preserving political stability and property rights.

One role the government has in the economy is to enforce antitrust laws. Antitrust laws are enforced in order to encourage the development of industries with as many competitors as possible. In other words, antitrust laws restrict one company from creating a monopoly; to keep a company from controlling the supply of a product and ultimately the price. Therefore, if there is more competition in a single industry, prices on those products will be lower in order to compete for and supply consumer demand.

Recently, Microsoft was brought to court because the U.S. Government believed the corporation had created a monopoly in its industry. The case was overthrown due to lack of evidence. The U.S. Government also has the Federal Trade Commission whom role it is to make sure that the nation's market functions efficiently and in a competitive manner. The FTC will also deal with cases outside the U.S. if they believe the market will be affected.

The government also gets involved to help preserve individual property rights. These regulations help to encourage people and companies to take risks in investing, starting new businesses, and even developing new inventions and ideas. One example of how the government helps to preserve property rights is when it helped artists to protect their music by shutting down Napster; a peer to peer file sharing program where people could illegally swap music over the internet. The government eliminated the free sharing and established a fee to download songs. Slowly the courts are diminishing these peer to peer programs and giving artists a reassurance that their published works are protected by law.

Another government role is to provide a stable fiscal and monetary environment. The government provides a stable currency, which is accepted globally, that eliminates the need for inefficient systems of barter, and to maintain the value of that currency through policies that increase the overall level of prices of goods and services. Another way to keep things stable is for the FED to increase the money supply which in turn lowers the interest rate. This brings on an overall increase in consumption. Fiscal policies introduce government spending and tax programs to stimulate the economy in times of high unemployment and low inflation or to slow it down when there's high inflation and low unemployment. If necessary the government will spend more or tax less.

Governments that maintain a politically stable environment enjoy a high degree of economic stability. The market tends to be stronger in these countries because there exists no uncertainty about unforeseeable events that would cause a major economic crisis.

Therefore, even though the government is kept at a distance from actual business activities it has ways of intervening by enforcing laws and regulations to keep businesses honest and the money flowing .

What is language? Dictionaries will tell you that it serves as a shared oral or written system of communication, but it has far greater significance than that simple description provides. Then again, Webster's has never dealt much in symbolism or metaphor. Language, in both structure and usage, speaks volumes (pun intended) about the people who speak it and the place it inhabits, both technically and culturally. Every modern tongue, and most ancient ones, descends form a long and complicated tree of linguistics that dates back to the first strung-together grunt man ever uttered. As the species spread over the continents and millions of years passed, the then-isolated groups twisted their original speech and turned it into statements of cultural identity. Nowhere in the modern world is this more prominent than in the form of modern English especially the American version. Our unique blend of ancestry and verbal irreverence has produced the most scattershot (and yet fastest-growing) language in the world. The ever-growing "global tongue" exemplifies the nature of the nation that spawned it, even though it also carries a few problems along the way.

The United States, of course, originally inherited its language and manner of speaking from the mother country of Great Britain. The language wasn't beautiful even then a Germanic base, coupled with successive invasions by the Latin-speaking Romans and the French-speaking Normans (who compared the native speech of their subjects to the baying of dogs), led to a disjointed and disorganized jumble of mixed roots and odd pronunciations. Because of a need for labor and settlers, the new nation normally allowed unrestricted immigration. This led to massive waves of Irish, Germans, Eastern Europeans, Chinese, and Hispanics, each bringing with them a new set of word families. In time, their speech intermingled with that of the original, forming a unique hybrid even farther from normal language rules than the first. The "melting pot" of the United States was fully reflected by the dialect of those within an all-absorbing hodgepodge of new and unusual vernacular. Nowhere else in the world can one hear such diverse words as kindergarten (German), abattoir (French), ski (Norse), tree (Old English), and shmuck (Russian Yiddish), and know what they all mean without a double fluency.

Unfortunately, this mixed nature sometimes causes problems with unclear ancestry and articulation. People often err in the use of a word merely because they have no idea which root to associate it with. For instance, the word forte. The most common definition derives from Middle English, means "specialty" or "strong point", and is pronounced "fort". A word with the exact same spelling comes from the Latin fortis, instructs a musician to play a particular note loudly, and is pronounced "fort-ay". The latter pronunciation has become commonplace, and threatens to encompass the first because of popular usage. While "fort-ay" is listed in the dictionary as the second preference, a reason exists why it's second because it's not first! Related words such as fortress (oddly enough, from both roots) compound the problem because of murky heritage. Because of so many different contributors to the language, similar-sounding words may have nothing in common. Coincidentally, the non-related word forty, a purely numerical term, claims lineage from no less than half a dozen ancestors, as far apart as Gothic, Norse, Frisian, and Semitic. Only in America.

Coping With Love and Theft

The remnants of plastic lay scrappily on the floor. The windows are drawn, and I lay on my bed. Bob Dylans newest album (his 4rd,) Love and Theft, had done what no person, place or thing (the entire day) had been able to do. It has comforted my troubled mind as well as let me reflect on the matters at hand.

From the moment I woke up before school, the day was different. I had been waiting several months for this date, because Dylans new album was to be released. However, it was not easy, as I had a hard time sitting through my classes (more than usual,) and I longed for the day to be over. Although school seemed like an eternity, dismissal finally came and I left the school.

As I walked down Broad Street, in Red Bank, towards Jacks Music Shoppe, several things struck me. Although it was a beautiful summer day, there was a hint of melancholy in every face that I passed. Some stores were closed, and those that were open seemed vacant. As I was stopped at a street corner, waiting for an opening in the flow of traffic so that I could cross, a woman standing next to me broke into tears. A man standing next to the lady hugged her, and he too began to sob.

Write your Coping with Love and Theft research paper

I enter the store, and am now totally debating within myself as to whether or not it is a good time to purchase the album. The fact that I have already made the trip to the shop leaves me with the impression that I might as well just pick it up while Im there (a far cry from the person who had been waiting months for it to come out.) I walk over to the Love and Theft stand, and I grab a copy, which is one of about five left in the store. I pay, and I am on my way.

I get home, and play the album.

In 17, Time Out of Mind put Dylan back onto the Rock and Roll map when it won a Grammy for its head-on deep and soulful reflection on slowing down in old age, as well as death. Four years later, Dylan is not as direct but hits the same points as he veers through songs of jazz, ragtime, country, rockabilly, minstrel, cocktail lounge, as well as deep blues that allow him to not only to laugh and reflect on his life, but to show that hes thought way too deeply of the past to be either frightened or overwhelmed by anybodys future, especially his own.

You cannot have power over everything in the future, although we sometimes think that we must. Sometimes, we fear the future. This is only a result of the fact that it is natural for us to be scared of what we dont know, and seeing as how no one truly knows the future, some things are bound to frighten us. When things happen beyond our control, especially tragedies, they remind us that we, as humans, are only mortal.

However, Dylan does not dictate others thoughts in this album, but rather, allows one to come to each one on his or her own terms. This is why Love and Theft is so crucial, especially on a day like this. I close my eyes, pray for those who have been devastated, and realize that though tremendously difficult, life will soon go on (just as it always does.)

I also pray that soon this day of infamy, when looked back upon, will allow me to face the future with steadfastness and resiliency. Until then, however, all I can do is turn the TV news off, and play the album once again, as this is where I will get all the guidance I need.

The day, is the 11th of September, Two-Thousand and One.
